By accessing or using Eatake, you agree to be bound by these terms of service. If you do not agree with any part of these terms, do not use the service. If you use the service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
Eatake is a menu digitization platform for restaurants and hospitality businesses. The service allows you to upload images of physical menus, process them with artificial intelligence to extract their content, edit the extracted data, and publish digital menus accessible via QR codes.
To use the service, you need to create an account by providing truthful and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately if you suspect unauthorized access. We reserve the right to suspend or cancel accounts that violate these terms.
Eatake offers a free plan with limited features and paid plans with extended features. Paid plans are billed monthly or annually according to the option selected. Prices may change with 30 days' prior notice. No refunds are offered for partial usage periods. You may change plans or cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
You agree to use the service only to manage menus for legitimate establishments. The following are prohibited: uploading illegal, misleading, defamatory, or offensive content; using the service to infringe on third-party intellectual property rights; attempting to access other users' accounts or Eatake's internal systems; using the service in a way that could damage, disable, or overload our infrastructure; and reselling or redistributing the service without prior authorization.
You retain ownership of all content you upload to Eatake, including images, menu data, logos, and business information. By using the service, you grant us a limited, non-exclusive, and revocable license to store, process, and display your content for the purpose of operating the service. By publishing a menu, you authorize its public display through the generated URL and QR code. You are responsible for ensuring that the content you publish is truthful and does not infringe third-party rights.
Eatake, its logo, design, source code, algorithms, and underlying technology are the property of Eatake and are protected by applicable intellectual property laws. These terms do not grant you any rights over our intellectual property beyond the limited use necessary to use the service.
The service uses third-party artificial intelligence (Google Gemini) to process menu images. The results of automatic extraction may contain errors. It is your responsibility to review and correct the extracted content before publishing your digital menu. Eatake does not guarantee the accuracy, completeness, or suitability of the AI processing results.
We strive to keep the service available continuously, but we do not guarantee uninterrupted availability. The service may experience scheduled interruptions for maintenance, updates, or improvements, as well as unscheduled interruptions due to technical causes or force majeure. We will notify you of scheduled maintenance with reasonable advance notice when possible.
Eatake is provided "as is" and "as available." To the maximum extent permitted by law, Eatake shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or customers, arising from the use or inability to use the service. Our total cumulative liability shall not exceed the amount you have paid for the service in the 12 months preceding the event giving rise to the claim.
You may delete your account at any time from your account settings or by contacting support. We reserve the right to suspend or terminate your access to the service if you violate these terms, with or without prior notice depending on the severity of the violation. After termination, your data will be deleted in accordance with our privacy policy.
We may modify these terms at any time. We will notify you of significant changes by email or through a notice on the platform with at least 15 days' advance notice. Continued use of the service after the notice period constitutes acceptance of the updated terms. If you do not agree with the new terms, you must stop using the service.
These terms shall be governed by and construed in accordance with the laws of the country where Eatake has its registered office. Any dispute arising in connection with these terms shall be submitted to the jurisdiction of the competent courts of said registered office.
